These General Terms of Sales (hereinafter “GTS”) are offered by Vincent Hürner whose head office is located Rue de Saint-Jean 36, 1203 Geneva. Vincent Hürner offers the customer (hereinafter “the Subscriber”) an application (video and audio), for the purpose of self discovery and non-therapeutic personal exploration. 

 

The Subscriber is invited to take out a monthly subscription (hereinafter “the Subscription”). Any Subscription request to the T.R.U.S.T. Program assumes acceptance of the conditions provided for in these GTS, which the Subscriber acknowledges having read, understood and accepted in full knowledge of the facts. 

 

These GTS are not made with Apple, Inc. or its subsidiaries, Google or its subsidiaries, or any other entity, if any. 

 

1. Acceptance of Terms 

 

Please read these GTS carefully. By creating an account, accessing or using the Application, you acknowledge that you agree to be bound by the terms of these GTS.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OR ACCESS THE APPLICATION. 

 

2. Application and opposability of the GTS

 

The purpose of these GTS is to define all the conditions under which Vincent Hürner markets the Subscriptions as offered for sale on the site to customers. They therefore apply to any Order (hereinafter “Order”) for a Subscription placed by the customer. The Subscriber declares to have read and accepted these GTS before placing his order. The validation of the order therefore implies acceptance of these GTS. These are regularly updated, the applicable GTS are those in force on the site on the date the Order is placed. 

 

3. Legal capacity 

 

Individuals declare that they are of legal age and fully capable of contracting. Signatories representing legal persons declare that they have full capacity to represent legal persons. 

 

4. Subscription 

 

The Subscriptions offered for sale are described and presented with the greatest possible accuracy. The Company reserves the right to correct the content at any time. The Subscription includes access to an online content platform allowing the follow-up of courses in the form of videos, audios and a discussion forum. Other supports are likely to be added gradually. This is a global offer that cannot be separated. 

 

4.1 Details of subscription offers 

 

The app offers a monthly subscription. The Monthly Subscription is non-binding and is automatically renewed from month to month. The subscriber is informed that they can terminate their subscription at any time but that the month started is due.

 

4.2. Subscription price 

 

The monthly subscription is priced at $28 USD per month. 

 

4.3 Methods of ordering subscriptions 

 

It is up to the subscriber to check, modify if necessary, then confirm the content of their subscription request. When ordering, the subscriber will be asked to fill in a questionnaire. They must take care to verify the accuracy and conformity of the information provided to Vincent Hürner. The latter cannot be held responsible for the consequences of any input errors. By validating their registration form, the subscriber acknowledges having been able to read and reflect on all the conditions of this contract and to accept them fully and without reservation. They consider that they were able to exercise their free choice. Vincent Hürner will systematically confirm the subscription request of each subscriber by e-mail. The subscription will be definitively validated upon receipt of payment by Vincent Hürner. 

 

5. Tacit renewal 

 

The monthly subscription is renewable by tacit agreement for periods of one month. 

 

6. End of subscription 

 

The Subscription is cancellable without notice, and can be made whenever you wish until the time of collection. Go to your application, click on “Profile”, select “Account settings” then make the necessary change in “Subscriptions”. 

 

7. Evidence 

 

Unless proven otherwise, the data recorded by Vincent Hürner constitutes proof of all past transactions and information exchanged between Vincent Hürner. 

 

8. Accessibility and Responsibility 

 

The T.R.U.S.T application is normally accessible by the subscriber 24 hours a day, 7 days a week and all year round except in the event of voluntary interruption or not, regardless of the cause. This may include maintenance. Being by its activity, subject to an obligation of means, Vincent Hürner cannot be held responsible for any physical, material or moral damage caused by the unavailability of the application. Vincent Hürner reserves the right, in case of imperative need, without notice or compensation, to temporarily close access and will not be liable for any damages of any kind that may arise as a result. 

 

9. Intellectual Property 

 

All the elements contained on the T.R.U.S.T. and in particular but not exclusively the texts, comments, works, illustrations, images, videos, soundtracks, drawings, models, trademarks or patents are protected under intellectual property. Any total or partial reproduction of the elements is strictly prohibited. 

 

10. Right and terms of withdrawal 

 

The right of withdrawal allows European customers to cancel a contract within 14 days of its effective date. As you can benefit from our service immediately after registering for it, we do not offer a right of withdrawal. Although Vincent Hürner does not offer a right of withdrawal in any European country: 

 

• you can cancel your automatically renewed monthly subscription for the following month by going to "Profile", then select “Account settings” and make the necessary change in “Subscriptions”. 

 

The law requires that we inform the customer that they does not have a right of withdrawal. When a European customer signs up for our service, we ask them to acknowledge that they waive their right of withdrawal. When the customer agrees to waive his right of withdrawal, this does not affect their other rights and does not prevent them from canceling their subscription under the conditions set out above. 

 

11. Responsibility for identifiers 

 

The subscriber is solely responsible for the use of his password, his e-mail address, his confidential codes as well as any information made accessible by the subscriber. Thus, taking into account the aforementioned elements, Vincent Hürner cannot be held responsible for the direct, personal and certain damage suffered by the subscriber as a result of his subscription to the service or the consultation of the T.R.U.S.T. Schedule. 

 

12. Personal information 

 

The information and data concerning the subscriber are necessary for the management of his order and his commercial relations. They can be transmitted to the companies which contribute to these relations such as those in charge of the execution of the services and orders for their management, execution, treatment and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to allow Vincent Hürner to improve and personalize the services it offers and the information it sends. 

 

13. Applicable law and jurisdiction 

 

Any dispute relating to the execution or interpretation of these General Conditions will be submitted to the competent court according to the nature of the dispute of the city of Geneva. The applicable law is Swiss law.
